The topic “Forms of Sale and Their Contemporary Applications” highlights the importance of clarifying Islamic rulings related to modern financial transactions. As commercial practices evolve with technological advancements, Muslims increasingly need guidance to ensure their dealings comply with Shariah law. This research addresses new forms of contracting and the necessity of understanding their legal status from a fiqh (Islamic jurisprudence) perspective.
The study aims to explain various forms of sale and associated jurisprudential issues, such as the requirement of continuity between offer and acceptance, and the concept of "Khiyar al-Majlis" (option of the session). It also examines sales conducted via correspondence, which have become widespread through modern communication tools like email and digital platforms. A key focus is the concept of “extended offer,” both when it is time-bound and when it is open-ended, with a detailed discussion of their respective legal rulings.
The research concludes that a time-bound extended offer is permissible in Shariah, provided the time period is clearly defined. Similarly, an open-ended offer is also likely permissible, based on the acceptance being allowed after the session ends. The study underlines the adaptability of Islamic law to modern developments and its ability to govern financial transactions fairly and effectively in all times and places.
