The juristic ruling of woman’s single testimony to prove rights in Islamic jurisprudence
Introduction
In the name of Allah، the Most Gracious، Ever Merciful. All due thanks and praise should be given to Allah who may send his mercy and blessing upon his prophet Muhammad with his family، companions and those who follow him. The great importance of testimony in Islamic law is attributed to its role to confirm one’s right، evading him great deal of the often-recurrent injustice and denial، and helping proof for the judge to pronounce the just and true judgment.
Islamic law facilitates the way to prove one’s right by accepting woman’s testimony، as well as men، as it is stipulated in the Holy Quran “And bring to witness two witnesses from among your men. And if there are not two men [available]، then a man and two women from those whom you accept as witnesses" (2:282). Islamic law، thus، respects woman testimony as confidential way to achieve rights. Noting this، I (this study) attempt to clarify the juristic tenet when a woman provides her testimony singularly، when they are not accompanied with men’s testimony to prove one’s rights. I divided this study، which comes under the title “the juristic ruling of woman’s single testimony to prove rights in Islamic jurisprudence”، into the following:
First chapter:Providing proofs for the judge and its importance.
Second chapter:The meaning of testimony، its tenets and its importance.
Third chapter:Juristic ruling of woman’s single testimony to prove rights.
Fourth chapter:The number of women for an accepted woman testimony to prove rights.
Fifth chapter:Accepting single woman’s testimony on the affairs which men are prohibited to see.
