This research examines the theory of representation (niyābah) in Islamic jurisprudence, a foundational concept that has helped shift Islamic legal writing from addressing isolated issues to forming unified theoretical frameworks. The theory plays a vital role in regulating contractual and administrative relationships, allowing individuals to act on behalf of others through legal or religious authorization.
The study aims to define the concept of representation, clarify its pillars, conditions, and types, and explore the related jurisprudential and maqāṣid-based (Shariah objectives) principles. It also highlights practical applications, reflecting the theory’s relevance in contemporary legal contexts.
The research is structured into an introduction, four chapters, a conclusion, and appendices. The first chapter defines the theory and associated terms such as agency (wakālah), guardianship (wiṣāyah), and authority (wilāyah), along with the key elements of representation. The second chapter discusses the evidences for its legitimacy, its conditions, and classifications. The third chapter explores the legal maxims and Shariah objectives underpinning the theory. The fourth chapter presents practical examples, including representation in financial expiations and obligatory Hajj.
This study offers a well-rounded view of the theory of representation, combining theoretical analysis with practical examples, and contributes to the enrichment of contemporary Islamic legal scholarship.
