The Punishment for the Crime of Abuse of Influence and False Accusation

Abstract

This research addresses the punishment for the crimes of abuse of influence and false accusation from a contemporary jurisprudential perspective, due to its significant role in regulating public behavior, achieving justice, and protecting public order from the misuse of authority and professional status. The importance of the topic lies in its direct engagement with issues commonly encountered in real life, such as exploiting one’s position for personal gain or directing false accusations that harm the reputation of innocent individuals. The study aims to clarify the Islamic legal rulings related to these two crimes, establish their jurisprudential foundations, and present suitable punishments aligned with the higher objectives of Sharia (Maqasid al-Shariah). The researcher adopted a scientific methodology combining descriptive, inductive, and analytical approaches, relying on classical juristic opinions, original sources, and a critical analysis of relevant texts and contemporary cases. The research includes an introduction and a preamble defining the key concepts, followed by three main chapters that discuss: the formula (sigha) of sale contracts, correspondence-based sales, and extended offers—both with fixed and indefinite time periods. The study concludes with a summary of key findings. Ultimately, the research concludes that Islamic law criminalizes both the abuse of influence and false accusations due to their severe harm to society and endorses appropriate punishments that ensure deterrence and justice in light of public interest and Shariah objectives.
